Calcasieu Parish Employee FCU . . . is a member owned financial institution providing you with competitive financial products and services that will enable you to meet your financial goals. We are equally committed to safeguarding your confidential information and protecting your privacy. This privacy policy informs you of what we do to protect your information and also some steps you can take to protect your personal and financial information.

Information We Collect

We collect a variety of nonpublic personal information about you from the following sources:

  1. Information we receive from you on applications or other forms

  2. Information about your transactions with us or others

  3. Information we receive from a consumer reporting agency

  4. E-mail and electronic information sources

  5. Information we receive from marketing surveys to provide new benefits and services

Disclosure To Parties that Provide Services

The Credit Union uses a variety of third party vendors to assist in offering competitive products and services to our members. We may disclose all of the information we collect to companies that perform marketing or other services on our behalf or to other financial institutions with whom we have joint marketing agreements.

How We Protect Your Personal and Financial Privacy

This Credit Union will partner only with companies that agree to maintain strong confidentiality protections and limit the use of information we provide. We will not continue a relationship with any third party vendor who violates this policy. We may disclose nonpublic personal information about you to the following types of third party vendors:

  • Financial service providers, such as companies providing mortgage or insurance services.

  • Non-financial companies, such as consumer reporting agencies, data processors, check/share draft and other printers, plastic card processors and government agencies.

Although we may be permitted by law to disclose certain information about our members, the Credit Union will not disclose that information if we determine it does not contribute to your financial interests. We will disclose information with your consent or if required by law.* (See Special Notices) If you decide to terminate your membership or you become an inactive member, we will continue to adhere to the privacy policies and practices as described in this notice. Per Regulation V, also known as the FACT ACT, the Credit Union may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.

How We Protect Your Information

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products and services to you. We maintain physical, electronic, and procedural safeguards that meet or exceed federal regulations to guard your nonpublic personal information.

Special Notices

In accordance with Section 326 of the USA Patriot Act*, you authorize us to verify and record information that identifies each person who opens an account. You further authorize us to check your account, credit, and employment history, and obtain a credit report from third parties, including credit reporting agencies, to verify your eligibility for any account or services you request.

We do not collect personal identifying information about visitors to our site, except as described below. Our servers collect standard non-identifying information about our visitors to the site, such as date and time visited, IP address, city, state, and country. This information is used to compile standard statistics on site usage. The Credit Union may use your e-mail address to send you important information relating to your account, to communicate with you to handle your request, and to inform you about other Credit Union products and services. Information you have provided to us will not be sold or transferred to other parties.

Disclosure Of Information Practices With Regard To Children

As Required By The Children’s Online Privacy Protection Act Personal information such as the name, address, e-mail address, telephone number, social security number, persistent identifier, or combination of various identifying elements, of children under the age of thirteen is not collected by Calcasieu Parish Employee FCU or www.TownofCheektowagaFCU.com. If a child elects to send e-mail or other electronic request to the Credit Union, we may respond to that e-mail or request. However, the e-mail address of the child will be deleted and no personal information will be collected, stored or disclosed.

What You Can Do To Help

We are committed to protecting the privacy of our members. You can help by following these simple guidelines:

  • Protect your account numbers, plastic card numbers, PINs (personal identification numbers) or passwords. Never keep your PIN with your card, which can provide free access to your accounts if your card is lost or stolen.

  • Use caution when disclosing your account numbers, social security numbers, etc. to other persons. If someone calls you explaining the call is on behalf of the Credit Union and asks for your account number, you should be aware that official credit union staff would have access to your information. They will not need to ask for it.

  • Keep your information with us current. If your address or phone number changes, please let us know. It is important that we have current information on how to reach you. If we detect potentially fraudulent or unauthorized activity or use of an account, we will attempt to contact you immediately.

Terms of Use

The Calcasieu Parish Employee FCU Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Calcasieu Parish Employee FCU Web Site constitutes your agreement to all such terms, conditions, and notices.

Modification of these terms of use

Calcasieu Parish Employee FCU reserves the right to change the terms, conditions, and notices under which the Calcasieu Parish Employee FCU Site/Services are offered. You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. Termination/Access Restriction

Calcasieu Parish Employee FCU reserves the right, in its sole discretion, to terminate your access to the Calcasieu Parish Employee FCU Site/Services and the related services or any portion thereof at any time, without notice. Calcasieu Parish Employee FCU may also terminate or suspend your access to Calcasieu Parish Employee FCU Site/Service(s) for inactivity, which is defined as failing to log into a particular service for an extended period of time, as determined by Calcasieu Parish Employee FCU. The amount of time that Calcasieu Parish Employee FCU currently considers as an "extended" period of time may be viewed in the FAQ relating to the particular service. Upon termination of the Calcasieu Parish Employee FCU Site/Service, your right to use the Calcasieu Parish Employee FCU Site/Service immediately ceases. Calcasieu Parish Employee FCU shall have no obligation to maintain any content or to forward any unread or unsent messages to you or any third party.

Language

It is the express will of the parties that this agreement and all related documents have been drawn up in English. C'est la volont é expresse des parties que la présente convention ainsi que les documents qui s'y rattachent soient rédigés en anglais.

General

The laws of the State of New York, U.S.A, govern this agreement. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in New York, U.S.A. in all disputes arising out of or relating to the use of the Calcasieu Parish Employee FCU Site/Services. Use of the Calcasieu Parish Employee FCU Site/Services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Calcasieu Parish Employee FCU as a result of this agreement or use of the Calcasieu Parish Employee FCU Site/Services. You agree to indemnify and hold Calcasieu Parish Employee FCU, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the Calcasieu Parish Employee FCU Site/Services. Calcasieu Parish Employee FCU reserves the right to disclose any personal information about you or your use of the Calcasieu Parish Employee FCU Site/Services, including its contents, without your prior permission if Calcasieu Parish Employee FCU has a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of Calcasieu Parish Employee FCU or its affiliated companies; (3) enforce the terms or use; or (4) act to protect the interests of its members or others. Calcasieu Parish Employee FCU's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Calcasieu Parish Employee FCU's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Calcasieu Parish Employee FCU Site/Services or information provided to or gathered by Calcasieu Parish Employee FCU with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed supers eded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Calcasieu Parish Employee FCU with respect to the Calcasieu Parish Employee FCU Site/Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Calcasieu Parish Employee FCU with respect to the Calcasieu Parish Employee FCU Site/Services. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.


Home Banking Disclosure

The following information describes the types of electronic funds transfers which are available to members through Online Banking/Internet Access and your rights and responsibilities concerning those transactions, including your rights under the Electronic Funds Transfer Act. You may want to print or save this document for future reference. Please read this document carefully. Some of the information may not pertain to you.

Other available services through Online Banking include:

The ability to download history files to be used to import files in Quicken or MS Money. If available, you may request to be enrolled in Online Bill Pay Service.

Limits on Withdrawals or Transfers:

Limitations on the frequency and dollar amounts of transactions made to and from your account(s) are:

Withdrawals and transfers from an account are limited to the available funds in the account.

Regulation D, at the discretion of the credit union, requires that no more than six (6) preauthorized automatic, audio response, telephone, or internet transfers may be made from your savings accounts during any one month. No more than three of these may be made by check, check card, computer, or similar order to a third party.

Online Banking does not permit withdrawals or transfers to or from Individual Retirement Accounts, Certificate Accounts, or Escrow accounts.

Mortgage loan payments must be equal to or greater than the scheduled payment amount.

Consumer Liability For Unauthorized Transfers:

CONTACT US AT ONCE if you believe your access device (password) has been lost or stolen. Telephoning is the best way to control your loss. Notice of unauthorized use must be confirmed in writing. You could lose all the money in your account. If you tell us within two (2) business days, you can lose no more than $50 if someone used your access device without your permission. If you do NOT tell us within two (2) business days after you learn of the loss or theft of your access device, and we can prove we could have stopped someone from using your access device without your permission if you had told us, you could lose as much as $500.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason kept you from telling us, we may extend the time periods.

We must hear from you no later than sixty (60) days after we sent you the FIRST statement on which the problem or error appeared. You must provide us with the following:

  1. Your name and account number;

  2. Description of the error you are unsure about, and why you believe it is an error or why you need more information;

  3. The dollar amount of the suspected error.

If you tell us verbally, we will require that you send us your complaint in writing within ten (10) business days or we may not credit your account. We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete the investigation. If the alleged error pertains to a point of sale or a transaction initiated outside of the United States or Puerto Rico, the forty-five (45) calendar days become 90 calendar days. If the alleged error occurs within the first 30 days of the opening and depositing to a new account the 10 business days become 20 and the 45 calendar days become 90.

If we decide there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may ask for copies of the documents that we used in the investigation.

Business Days:

Our business days are Monday-Friday. Holidays are not included.

Charges:

There are no monthly charges to maintain your Online Banking Access with an Calcasieu Parish Employee FCU checking account. There may be a monthly service fee for using our optional Bill Pay service, if available. If you elect to enroll in Bill Pay, these fees will appear on your monthly statement; see separate fee schedule. *

Preauthorized Payments:

The Credit Union will charge your account if it must dishonor a preauthorized transfer from your account due to insufficient funds or if a stop payment order is received. See fee schedule. *

Disclosure Of Account Information To Third Parties:

Information about your account is confidential. We will not disclose such information to third parties except where necessary to complete a transfer, to report or confirm the condition of your account for a credit bureau, or in order to comply with a government agency, or court order or if you give us your written permission.
